The General Administration of Customs issued Notice No. 53: 19 kinds of medical materials with customs codes are subject to export legal inspection

Just now, the General Administration of Customs issued Announcement No. 53 of 2020 stating that exporter inspection will be carried out on medical supplies under customs commodity numbers such as "6307900010" (see attachment for details).

In order to strengthen the supervision of the export quality of medical supplies, in accordance with the "Law of the People's Republic of China on Import and Export Commodity Inspection" and its implementation regulations, the General Administration of Customs has decided to deal with medical supplies ( For details, please refer to the attachment) to implement export commodity inspection.

Statutory inspection
The entry-exit inspection and quarantine agency shall conduct inspections on the import and export commodities listed in the catalog and other import and export commodities that are required to be inspected by the entry-exit inspection and quarantine agency as required by laws and administrative regulations.
Legal inspection refers to the goods whose supervision conditions are A (import) or B (export) on the customs declaration form. The customs clearance form of the inspection bureau must be provided at the time of customs declaration, that is, the statutory inspection goods. If there is no A or B, it is not considered a legal inspection cargo. There is no need to provide a customs clearance form during customs declaration.
That is, the goods subject to statutory inspection include: ①in the catalog of legal inspection; ②other import and export commodities that are required to be inspected by laws and administrative regulations.
Legal basis
"The Import and Export Commodity Inspection Law of the People's Republic of China"
Article 15 The consignor or agent of export commodities that must be inspected by the commodity inspection agency as stipulated in this law shall report to the commodity inspection agency for inspection at the place and within the time limit specified by the commodity inspection agency. The commodity inspection agency shall complete the inspection within the time limit uniformly stipulated by the national commodity inspection department and issue an inspection verification form.
"Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China"
Article 24 Shippers of export commodities subject to statutory inspection shall report to the entry-exit inspection and quarantine agency for inspection at the place and within the time limit uniformly stipulated by the General Administration of Customs, with necessary vouchers such as contracts and relevant approval documents. Export commodities subject to statutory inspections that have not been inspected or are unqualified after inspection shall not be allowed to be exported.
Export commodities should be inspected at the place of production of the commodities. The General Administration of Customs may designate inspections at other locations in accordance with the needs of facilitating foreign trade and inspection of imported and exported commodities.
For the export of commodities subject to verification management, the consignor shall apply to the entry-exit inspection and quarantine agency for verification. The entry-exit inspection and quarantine agency shall conduct verification in accordance with the regulations of the General Administration of Customs.
"The Import and Export Commodity Inspection Law of the People's Republic of China"
Article 33 In violation of the provisions of this law, import commodities that must be inspected by the commodity inspection agency are sold or used without approval, or export commodities that must be inspected by the commodity inspection agency are exported without approval of the inspection. The commodity inspection agency shall confiscate the illegal gains and impose a fine of not less than 5 percent but not more than 20 percent of the value of the goods; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law.
